TERMS AND CONDITIONS
General Aspects of Contracting
The contracting of any service offered by the MACHUPICCHU OVER MOUNTAIN Travel Agency (hereinafter THE AGENCY) implies the total acceptance of these General Conditions. Both THE CLIENT and THE AGENCY expressly submit to said clauses.
RATES: Prices are expressed in US dollars and/or soles at the exchange rate in effect at the date of publication. The conversion to national currency is determined by the exchange rate set by THE AGENCY in effect at the date of each payment. It is understood that any variation in the prices of services, taxes, fees and/or currency exchange rate may give rise to a revision of the final price; THE AGENCY requests the sending of a guarantee between 30 and 50% of the total cost of the services to be contracted:
This can be made through authorized payment systems. THE CLIENT must pay the outstanding balance before the start of the services, which can be done in cash or by credit card (if payment is made by credit card, the CLIENT must assume an 8% increase in the amount to be paid). The shipping costs of the guarantee must be fully assumed by THE CLIENT.
INCLUDED SERVICES: Prices include only the services as confirmed by the service.
NOT INCLUDED SERVICES: Any other service not expressly listed:
1) Excess baggage in air transport, visas, airport taxes, service taxes, tips, vaccination certificates, extras, drinks, special diets, optional hotel services, laundry, VAT and other current and/or future taxes;
2) Accommodations, meals and/or additional expenses or damages caused by cancellations, delays in the departure or arrival of the means of transport, or for unforeseen reasons beyond the company’s control.
3) Food en route, except those that are expressly included.
DOCUMENTATION: For trips abroad it is necessary to comply with the legislation in force in each case. It will be the exclusive responsibility of the CLIENT to have the personal and family documentation required by the corresponding immigration authority. It is also mandatory for the client to carry their documents throughout their trip, as well as the Andean Migration Card (TAM) that is issued upon entering our country, since said document excludes all visitors from internal taxes.
LUGGAGE: Luggage is the sole responsibility of the CLIENT. THE AGENCY is not obliged to respond for any loss, damage or deterioration that may occur during the trip.
HOTELS: The quality and content of the services provided by the hotel are determined by the official tourist category assigned. In the event that THE AGENCY is forced to change the confirmed hotel due to the celebration of special events and/or situations beyond its control, its responsibility will be limited to offering a hotel of equal or higher category. The costs of accommodation, food, transport and others that arise as a result of delays in departures and returns of means of transport (or lack of connecting flights) due to meteorological, technical, strike or other causes of force majeure will be the responsibility of the CLIENT. The rooms contracted are of standard type, unless otherwise specified in writing.
REFUNDS:
At the time of booking confirmation, fifty (50%) percent of the total amount of the SERVICE must be deposited. In this case, no place will be considered as firmly committed until said deposit is made and the requested services are fully confirmed. Until the time of confirmation of the SERVICE, it may be subject to modifications in any of its conditions. Packages and tours must be reserved with payment of forty (50%) percent of the total value of the same. If any condition is modified at the time of final confirmation, THE CLIENT may choose to cancel the operation, having the right to a refund of all amounts paid for the reservation.
CUSTOMER CANCELLATIONS AND/OR CANCELLATION OF THE TRIP:
At any time THE CUSTOMER may cancel the services requested or contracted and be entitled to a refund of the amount paid. Cancellations or changes made by THE CUSTOMER must be submitted in writing by the client as soon as possible, subject to compensation to THE AGENCY for the concepts detailed below: 1) Management costs (incurred by the selling agency). 2) Cancellation costs, if any (incurred by the tourist providers). 3) Compensation consisting of a percentage of the total amount, depending on the type of service contracted and the cancellation policy of the service provider. In the event of no-show at the time of departure without prior documented cancellation, or late presentation, this will result in the total loss of the amount and the SERVICE. Some contracted services are subject to special economic cancellation conditions in which one hundred (100%) percent of the tickets already issued must be paid regardless of how far in advance the cancellation occurs (air tickets, accommodation, pre-purchased Inca Trail tickets, entrance to Machu Picchu – Huayna Picchu, etc.). In these cases, cancellation fees will be established according to the specific conditions of each provider. In the event of cancellation of credit operations, the amounts paid for the report, administrative fees, stamps and interest will not be reimbursed.
Specs:
- It should be noted that air services on the Nazca Lines-Paracas route are also subject to a 100% NO SHOW charge if they are not cancelled a maximum of 7 days prior to the travel date.
- Regarding hotel reservations. Reservations can only be cancelled or modified within 15 days prior to the check-in date. Cancellations made after this period will automatically be subject to penalties and a NO SHOW equivalent to 30% to 50% of the total amount paid in advance. Hotels apply this policy in a rigid manner, making it impossible to transfer reservations between passengers of an agency, i.e. payments made are exclusively for one passenger and cancellation does not allow the exchange to another passenger.
- Regarding train services to Machu Picchu. The companies Perú Raíl and IncaRail allow the cancellation of train tickets within 48 hours before the travel date, in order to free up spaces, but this entails the charging of a penalty equivalent to 15% of the total value of the train ticket, whether due to natural causes or personal circumstances. In addition, THE CLIENT must send THE AGENCY by e-mail a scanned copy of their passports with a notarized letter authorizing the return to THE AGENCY.
- Regarding Services. Guide services, transportation (to attractions), entrance tickets, THE AGENCY will refund 100% of the cost of the services as long as the cancellation is made at least 2 days in advance, except for those events in which we do not have direct management such as the Inti Raymi festival, which, whether due to natural or personal causes, the total value of said event will be lost..
- Regarding the Inca Trail. In the case of the Inca Trail and the different hikes that include this itinerary (4 days/3 nights or 2 days/1 night), the entrance fee is not refundable, it does not allow exchanges, transfers, etc. This is due to the policies of the Regional Directorate of Culture in Cusco. Since the services are reserved and paid for at the time of closing the sale due to the availability of places, it is not possible to rectify dates, change itineraries or similar, so 100% of the Inca Trail entrance fee will be charged.
ALTERATIONS AND MODIFICATIONS OF THE TRIP:
THE AGENCY reserves the right, for technical or operational reasons, to totally or partially alter the daily arrangement and/or services that make up the trip, before or during the execution of the same. Unless otherwise expressly stated, the stipulated hotels may be changed for another of equal or higher category at no charge to the passenger. Regarding these variations, THE CLIENT will not be entitled to any compensation. Once the trip has begun, the suspension, modification or interruption of the services by the CLIENT for personal reasons of any kind will not give rise to any claim, reimbursement or refund.
THE AGENCY may cancel and/or modify the trip itinerary when any unforeseen circumstance occurs, such as strikes, weather factors, roadblocks, etc. If THE CLIENT continues the trip with the solutions given by THE AGENCY, it will be considered that he tacitly accepts said proposals, and may not claim any compensation from THE AGENCY, said program modification being framed within the natural process of negotiation of the requested services. We reserve the right to cancel a trip at any time for a reason that, in our opinion, could compromise the quality of the trip or the safety of passengers or any other circumstances beyond our control (strikes, protests, flight cancellations, weather conditions).
CUSTOMER RESPONSIBILITY:
In the event of any failure to perform the SERVICE, THE CUSTOMER is obliged to notify the service provider informed in their booking confirmation and THE AGENCY, in a reliable manner and as soon as possible. It is THE CUSTOMER’S responsibility to inform themselves about the restrictions on the airfares they are purchasing. Promotional fares do not normally allow refunds, date changes, or other modifications.
AGENCY RESPONSIBILITIES:
THE AGENCY is responsible to users for the full provision and quality of the services described in this program and is subject to its liability clause contained in accordance with the rights of the client.
KNOWLEDGE AND ACCEPTANCE OF THE CONDITIONS:
THE CUSTOMER is notified and accepts the content of the General Conditions of the Machupicchu Over Mountain agency. THE AGENCY is exempt from all liability for any inconveniences that may arise, with it being expressly stated that the passenger has been advised with this information.
